The AstroJyotish Website/App Terms and Conditions (this ’Agreement’) are applicable to all users (‘you’ and every ‘Member’) who access and/or use the platform for online advice and professional consultation services (‘Expert Platform’) available at www.astrojyotish.co.in and/or other B2B solutions, mobile applications and website powered by GIT Software Technologies through www.astrojyotish.co.in (each a ‘Site’ and collectively a ‘Sites’)

The Sites are currently owned and operated by GIT Software Technology (‘AstroJyotish’).

UPDATION

AstroJyotish reserves the right to modify or update these Terms of Usage at any time. No notice of such update or modification shall be sent to a User or a Registered Member and such User or Registered Member is required to check the Terms of Usage periodically to keep updated with these Terms.

USER CONSENT

By accessing the Website/App and using it, you indicate that you understand the terms and unconditionally & expressly consent to the Terms of Usage of this Website. If you do not agree with the Terms of Usage, please do not click on the “I AGREE” button. The User is advised to read the Terms of Usage carefully before using or registering on the Website or accessing any material, information or services through the Website. Your use and continued usage of the Website (irrespective of the amendments made from time to time) shall signify your acceptance of the terms of usage and your agreement to be legally bound by the same.

AstroJyotish is an online portal having a website “www.astrojyotish.co.in” and “mobile application.”
Astro Jyotish Website/App is an internet-based portal having its existence on World Wide Web and it provides astrological related content, reports, data, telephone, chat, video etc (hereinafter referred as “Content”). The Website or App offers “Free Services” and “Paid Services” (Collectively referred as “Services”) to the users. Free Services are easily attainable without becoming a registered user however for accessing the personify astrological services and/or receiving additional Content and getting access to Paid Services, You are required to register as a User on the Astro Jyothi website or mobile app. The use of this platform by both Users and astrologers is at their sole risk and discretion.

Services Overview

AstroJyotish provides a platform where any registered User can avail the consultation services from the list of registered Astrologers in the platform. Users can avail these online consultation service or advice upon payment. Users have the freedom to choose their own preferred Astrologers for their specific needs based on cost, experience, specialization etc. Users can check who are currently available at that particular time online and connect with them over chat or video calls. AstroJyotish may categorically present all these astrologers in the website or mobile App but Users are free to choose any astrologer of his/her choice. Users can also take these consulting services from one or more number of astrologers.

AstroJyotish provides Astrologers by bring either experienced or certified Astrologers to provide their online services via the platform. AstroJyotish takes adequate care and takes necessary steps to maintain the quality of reasonable and acceptable standards of professional service providers. Since Astro Jyotish is a platform connecting both the Users and the Astrologers, we would not be responsible for any advice or discussion between the Users and astrologers. AstroJyotish will not be responsible if Users consults two or more Astrologers and their opinion differs from each other.

User Registration and Eligibility

The User of AstroJyotish or App must be a person not be a bot, who can form legally binding contracts under Indian Contract Act, 1872. In case, if you are a minor under the age of eighteen (18), you are not permitted to avail the services provided on the Website without a legal guardian in accordance with the applicable laws. By all means, the Website would not be held responsible for any misuse that may occur by virtue of any person including a minor using the services provided through the Website.

To avail the various online Astro related services, you will be directed to Register as a User on the Website or Mobile application. To register as a User you should agree to provide updated, complete, reliable and accurate information while filling up the sign-in form as part of the registration process. These information provided to the Website are referred to in these Terms of Usage as "Registration Data or User Data"

You can create your User Account using your registered mobile number with an OTP to get access to your user account.

Use of another User’s account information (example Mobile No, Email id, social media credentials) for availing any of the services mentioned in the website/App is expressly prohibited. If in case it is found that the User information provided on the Website/App for registration purposes is inaccurate, incomplete, untrue and not current, AstroJyotish Website or App has the right to suspend or terminate the User’s account and restrict/refuse the use of the Website/App by such User in future.

Please note that the right to use this Website/App or its associated Astro services is personal to the User and is not transferable to any other person or entity. The User would be responsible for protecting the confidentiality of their passwords and other information required for the registration purposes. The User would be completely responsible for all the activities that are associated with the User’s account either for the Website or the Mobile Application. Astro Jyotish website or its Mobile application cannot and will not be liable for any loss or damage arising from the User’s failure to maintain secrecy and confidentiality associated with their account. In case, if the User become aware of any illegitimate use of their Accounts or any breach of security, they should immediately notify the Website/App authorized personal.

Moreover, temporarily or indefinitely suspended members of AstroJyotish are also not eligible for using our services. Even, people prohibited by the law can also not take these services.

Communication with Astrologers

AstroJyotish’s Services also include consultation with various astrological experts (“Astrologers”) who have enrolled with AstroJyotish App to provide consultation to our Users via electronic mediums including but not limited to phone calls, video calls, texts, etc. Your consent to these Terms also constitutes your consent to us arranging a consultation call with such Astrologers should you choose to avail of a Service that requires such telephonic consultation.

The Astrologers enrolled with us are prohibited to share their personal details like contact number, email, social media username, address, etc with any User and are also prohibited to indulge in or suggest activities such as black magic, vashikaran, or suggest any pooja using these tantras.

The Users hereby agree to promptly inform AstroJyotish of any violation or attempt at a violation of such Terms by an Astrologer. Failure on the part of a User or a Registered Member to furnish such information may lead to a temporary suspension of the Registered Member’s account or restriction on such User to access the Website as the case may be.

User Obligations

Registered Users in AstroJyotish website/App should concede with the following user obligations as part of the terms and conditions of the website.

The User agrees to receive notifications, emails, calls and SMS from the AstroJyotish Website/App.

As a User, you will not post, publish or transmit any messages that is inappropriate, harassing, misguiding, defamatory, fake, harmful, intimidating, abusive, seductive, invades other’s privacy, offensive, promotes racism, hatred or harm against any individual or organizations or group or religion or caste, infringes other's rights including any intellectual property rights or copyright or trademark, violates or encourages any conduct that would violate any applicable law or regulation or would give rise to civil liability.

The User should not send voluntary email, junk mail, spam, or chain letters, or promotions or advertisements for services which is irrelevant to the Astro Jyotish core line of business services.

The User should not collect, capture, screen shots, references, names and email addresses of members, contact details of those who are registered on AstroJyotish Website/App for purposes of advertisement, solicitation or spam.

The User should not upload or distribute files that contain malware, viruses, corrupted files, or any other similar software or programs that may potentially damage or affects the operation of the Website or other’s computer, servers, network systems.

The User should not engage in any activity that interferes with or disrupts access to the AstroJyotish Website/App.

The User should not attempt to gain unauthorized access to any portion or feature of the Website, any other systems or networks connected to the Website, to any of the services offered on or through the Website, by hacking, password drilling or any other unauthorised means.

The User agrees not to transmit via the Website/App any unlawful, harassing, libellous, abusive, threatening, harmful, vulgar, obscene or otherwise objectionable material of any kind or nature.

The User should not transmit any material that resulting in criminal offense, leading to civil liability, or otherwise violate any applicable local, state, national or international law or regulation.

If the user notices any abuse or misuse of the Astro Jyotish site or anything which is in violation of Terms and Conditions, you shall report such violation to the website by writing to Customer Care or inform the support no. On receipt of such issues, the admin or respective team may evaluate and further investigate and if necessary, may terminate the membership of the concerned User responsible for such violation abuse or misuse without any refund of current pending or any holding fee (i.e., registration fee, subscription fee, transaction fee etc).

User should not make a false claim or a fake complaint against any of the astrologers in the Astro Jyotish platform, and such User will be liable for discontinuation of his/her membership without any refund of current pending or any holding fee (i.e., registration fee, subscription fee, transaction fee etc)..

User should conduct themselves with absolute modesty respecting the privacy of the Astrologers during their audio or video call interactions. Astro Jyotish website has the right to withdraw its services to any customer who is found to be irrational or abusive during their conversation with the Astrologers.

Users should not engage with the Astrologers from the AstroJyotish website/App by requesting their contact details like email, phone numbers etc since the AstroJyotish website or platform is the primary medium to bring both Users and the Astrologers in this common platform.

DND communication: The user will be required to provide a valid phone number at the time of using the service through the platform. By registering the user's phone number with us, the user gives consent to be contacted by us via phone call. BANK ACCOUNT INFORMATION

The User is under an obligation to provide his banking information as and when required. For that purpose, the obligation of the User are:-

• The User agrees that the debit/credit card details provided by him/ her for use of the aforesaid Service(s) must be correct and accurate and that the User shall not use a debit/ credit card, that is not lawfully owned by him/ her or the use of which is not authorized by the lawful owner thereof. The User further agrees and undertakes to provide correct and valid debit/credit card details.
• The User may pay the fees required, to the Website/App by using a debit/credit card or through online banking account. The User warrants, agrees and confirms that when he/ she initiates a payment transaction and/or issues an online payment instruction and provides his/ her card / bank details:
• The User is fully and lawfully entitled to use such credit / debit card, bank account for such transactions.
• The User is responsible to ensure that the card/ bank account details provided by him/ her are accurate.
• The User is responsible to ensure sufficient credit is available on the nominated card/ bank account at the time of making the payment to permit the payment of the dues payable or the bill(s) selected by the User inclusive of the applicable Fee.

The User further agrees that if any part of these Terms of Usage are determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth herein, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of these Terms of Usage shall continue in effect.

PROPRIETARY RIGHTS TO CONTENT

The User acknowledges that the Content, including but not limited to text, software, music, sound, photographs, video, graphics or other material contained in sponsor advertisements or distributed via email, commercially produced information presented to Member by the Website, its suppliers, and/or advertisers, is protected by copyrights, trademarks, service marks, patents and/or other proprietary rights and laws. The User is not permitted to copy, use, reproduce, distribute, perform, display, or create derivative works from the Content unless expressly authorized by the Website, its suppliers, or advertisers. Moreover, the content such as images, text, designs, etc on all of the portals of the Website are taken from various online portals such as Google Images. AstroJyotish or GIT Software Technologies is not liable for any copyrights of that content or data.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with Indian laws. All disputes under these Terms shall be referred exclusively to courts in Delhi NCR, India. Any dispute or claim arising out of or relating to these Terms including the determination of the scope or applicability of these Terms, or use of the AstroJyotish Application or any information provided thereof, shall be resolved through arbitration conducted by a sole arbitrator appointed by mutual consent of the User or Registered Member and the Website/App. The arbitration shall be governed by the Arbitration and Conciliation Act, 1996, and the rules made thereunder. The venue of the arbitration shall be Delhi NCR and the language of such arbitral proceedings and award rendered shall be English. The award delivered pursuant to such arbitral proceedings shall be final and binding on the parties to the dispute.

Notwithstanding anything contained herein above, every party to a dispute shall have the right to seek interim relief from a court of competent jurisdiction in Delhi NCR to safeguard the rights of such party pending any arbitration proceeding initiated.

Notices

Unless expressly stated otherwise, all notices to AstroJyotish shall be in writing and shall be sent via email or through the post. The rules concerning the communication of acceptance under the Indian Contract Act 1872 shall apply to the receipt of a notice sent by a User, Registered Member, or the Website. Notices to a Registered Member shall be sent to the email address provided during the registration process. Notices to the Website, if sent by post shall be sent at the following address: “ 9530,Main Delhi Mathura Road, Bamni Khera, Palwal, Haryana-121105”.

THE USER ACKNOWLEDGES THAT IT HAS READ THESE TERMS OF USE, UNDERSTANDS THEM, AND AGREES TO BE BOUND BY ITS TERMS. THE USER FURTHER ACKNOWLEDGES THAT THIS AGREEMENT DOES NOT HAVE TO BE SIGNED IN ORDER TO BE BINDING. THE USER WILL HAVE INDICATED ITS ASSENT TO THE TERMS OF THE AGREEMENT BY CLICKING ON THE "ACCEPTED AND AGREED TO" (OR SIMILAR BUTTON) THAT IS PRESENTED TO THE USER AT THE TIME OF ITS OPENING OF AN ONLINE ACCOUNT WITH THE COMPANY.
